Terms & Conditions

Bach.ai is operated by Wittelsbach Private Limited (“Wittelsbach”, “we”, “our”, “us”), a company registered in India. These Terms & Conditions (“Terms”) govern your access to and use of Bach.ai — our agentic Meta Ads operator (the “Service”) — at https://www.wittelsbach.ai and https://app.wittelsbach.ai. By creating an account or using the Service, you agree to these Terms; if you do not agree, do not use the Service.

1. The Service

Bach.ai is an agentic Meta Ads operator for e-commerce brands. It audits your connected advertising account, identifies potential improvements, and — only after you approve a proposed change — executes that change on Meta. Google Ads is connected for intelligence (audit and insights) on paid plans; full Google Ads execution is on the roadmap. The Service remains read-only with respect to your connected accounts until you explicitly approve an action.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that you are authorized to act on behalf of any business whose accounts you connect.

3. Accounts and security

• You are responsible for the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account.

4. Connected accounts and authorization

When you connect a Meta Ads account, e-commerce store, or other third-party account, you authorize us to access the data required to provide the Service and to make the specific changes you approve. You represent that you have the right to connect those accounts and to authorize these actions.

• You remain responsible for every change you approve, and for your compliance with the terms and policies of the connected platforms (including the Meta Platform Terms).
• You may disconnect a connected account or revoke access at any time.
• Approved actions are logged and, where the platform allows, reversible.
• Where the accounts you connect contain personal data of your own customers, we process that data as your processor, solely to provide the Service. Business customers who require a Data Processing Addendum for that data can request one at info@wittelsbach.ai.

5. Plans, trials and billing

• Paid plans are offered on a monthly, self-serve basis. Eligible plans include a 7-day free trial that does not require a credit card up front.
• By starting a paid subscription you authorize us (through our payment processor) to charge the applicable recurring fee until you cancel.
• Fees are stated exclusive of taxes unless noted; you are responsible for any applicable taxes.
• You may cancel at any time and will retain access through the end of the period you have paid for. Refunds are governed by our Refund Policy.
• Subscription fees are separate from any advertising spend you pay directly to Meta or other platforms.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful, deceptive, or abusive purpose;
• Attempt to reverse engineer, copy, or resell the Service except as permitted by law;
• Interfere with or disrupt the integrity or performance of the Service;
• Access the Service to build a competing product, or misuse it in violation of any connected platform’s terms.

7. Intellectual property

The Service, including its software, models, design and content, is owned by Wittelsbach and protected by applicable laws. You retain ownership of your own account data. You grant us a limited licence to process that data solely to provide and improve the Service, as described in our Privacy Policy.

8. No performance guarantees

The Service provides analysis, recommendations and automation to help you manage advertising. We do not guarantee any specific result, including any particular ROAS, CPA, revenue, or level of performance. Advertising outcomes depend on many factors outside our control, including your products, budgets, creative, market conditions and the connected platforms themselves. Any figures shown before you connect your account are clearly labelled category estimates, not promises.

9. Third-party services

The Service relies on third-party platforms (such as Meta, Google, Shopify, WooCommerce, Magento and payment processors). We are not responsible for the availability, accuracy, or actions of those platforms, and your use of them is subject to their own terms.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Wittelsbach will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or advertising spend, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us, other users, or the connected platforms. On termination, your right to use the Service ends; data handling on termination is described in our Data Retention Policy.

13. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. You and Wittelsbach agree that the courts at Hyderabad, Telangana, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you have under the law of your country of residence.
